These Terms of Service ("Terms") govern your access to and use of the Roomagen website at roomagen.com and all related services, features, and tools (collectively, the "Service") operated by Roomagen ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

Roomagen provides an AI-powered platform for real estate photo enhancement and virtual staging. Our Service includes, but is not limited to:

AI virtual staging of empty or furnished rooms
Real estate photo enhancement and HDR editing
Object and furniture removal from photos
Day-to-dusk and sky replacement transformations
Virtual renovation previews
Virtual landscaping and exterior enhancements
Floor plan generation and 3D rendering
Image upscaling and quality improvement

Our AI processing is powered by Google Gemini 3 Flash technology. Results are generated automatically and may vary based on input image quality, selected settings, and the nature of the transformation requested.

2. Account Registration

You must be at least 16 years old to create an account and use the Service.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account.
You agree to provide accurate, current, and complete information during registration and to keep it updated.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

Upload images you do not have the right to use or that infringe on third-party intellectual property rights.
Use the Service to create misleading, fraudulent, or deceptive real estate listings that misrepresent property conditions or structural features.
Upload images containing personally identifiable information of individuals without their consent (e.g., faces, license plates).
Use the Service to generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
Use automated means (bots, scrapers) to access or interact with the Service beyond the provided API.
Circumvent any rate limits, access controls, or usage restrictions.
Resell or redistribute the Service without our written authorization.

4. AI-Generated Content Disclaimer

Important: All images produced by Roomagen are AI-generated representations and do not depict actual physical conditions of any property. You acknowledge and agree that:

AI-generated images are artistic interpretations, not factual representations of a property's current state.
Virtual staging, renovation previews, and other transformations show possibilities, not guarantees of what a property will look like after actual work.
You are responsible for clearly disclosing to potential buyers, tenants, or other parties that images have been virtually staged or AI-enhanced, in compliance with your local MLS rules, NAR guidelines, and applicable laws.
Roomagen is not liable for any misunderstandings, disputes, or legal issues arising from the use or misuse of AI-generated images in property listings or marketing materials.
AI processing may occasionally produce artifacts, inconsistencies, or inaccuracies. You should review all outputs before use.

5. Intellectual Property

5.1 Your Content

You retain all ownership rights to the original images you upload to the Service. By uploading images, you grant Roomagen a limited, non-exclusive, worldwide license to process, transform, and store your images solely for the purpose of delivering the Service to you.

5.2 Output Images

You own the AI-processed output images generated from your uploaded content. You may use them for personal and commercial purposes, including real estate listings and marketing, subject to applicable disclosure requirements.

5.3 Our Property

The Service, including its design, code, AI models, branding, logo, and all related intellectual property, remains the exclusive property of Roomagen. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the Service as described herein.

6. Pricing, Payments, and Subscriptions

Free accounts are subject to monthly usage limits as described on our pricing page.
Paid subscriptions are billed monthly or annually, depending on your selected plan.
All fees are quoted in US Dollars and are non-refundable except as provided in our Refund Policy (Section 7).
We reserve the right to change pricing with 30 days' written notice. Existing subscriptions will be honored at their current rate until the end of the billing period.
Failure to pay may result in suspension or termination of your account.

7. Refund Policy

We offer a 30-day satisfaction guarantee for paid plans. If you are not satisfied with the Service, you may request a full refund within 30 days of your initial purchase by contacting us at [email protected]. Refunds for renewal payments are available within 7 days of the renewal charge. Refunds are processed to the original payment method within 5-10 business days.

8. Service Availability and Modifications

We strive to maintain the Service available 24/7, but do not guarantee uninterrupted access. Scheduled maintenance, updates, and unforeseen outages may occur.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice.
We are not liable for any loss resulting from temporary unavailability of the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that AI-generated results will be error-free, accurate, or suitable for any particular use.
In no event shall Roomagen, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or relating to your use of the Service.
Our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to Roomagen in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Roomagen and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service or violation of these Terms.
Your use of AI-generated images in real estate listings or marketing without proper disclosure.
Your infringement of any third-party intellectual property or privacy rights.
Any content you upload to or transmit through the Service.

11. Account Termination

You may delete your account at any time through your account settings or by contacting us.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service.
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, except as required by law.
Provisions that by their nature should survive termination (including Sections 4, 5, 9, 10, and 13) will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with a new "Last updated" date and, for significant changes, via email. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey. Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.

14. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Roomagen regarding the Service.
Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
